Joseph Swerdzewski (Managing Partner)

Mr. Swerdzewski obtained his law degree from Fordham University Law School in 1975. In 1993 President William J. Clinton appointed him General Counsel of the Federal Labor Relations Authority after confirmation by the United States Senate. He was appointed by President Clinton and confirmed by the Senate for a second term in 1998. He is the only General Counsel to have been appointed for a second term. He is well known for his advice and policy issuances on labor relations topics for the federal sector, which he issued while General Counsel. His creative approaches to dispute resolution led to a significant reduction in case filings during his tenure. He left the FLRA in 2001 to become President and CEO of FPMI Solutions, a federal government human resource and training contractor. While leading FPMI through a period of significant expansion of its federal business, he also acted as a labor relations consultant to federal agencies and performed numerous speaking engagements nationwide. He is a much sought-after speaker, having presented over 200 speeches and seminars on labor and employment subjects throughout the United States and abroad. He started Joseph Swerdzewski and Associates (JSA) in July 2005.


David B. Brooks (Partner)

Mr. Brooks has twenty-eight years of Federal Human Resources Management experience at the operating and staff levels within the Department of the Army.  Extensive operating level experience as a Human Resources Officer, providing a full range of human resources services to include, classification; staffing and recruitment outreach; management employee/labor relations; human resources development; and personnel action processing/record keeping.  Significant experience in providing Human Resources services to a broad and diverse workforces to include, medical; professional; research and development; engineering; administrative; and trades and crafts workforces.  Demonstrated experience in developing concept and operational plans for major human resources initiatives, to include regionalization of human resources services, consolidation and transition of servicing for populations exceeding 100,000 and major staffing and recruitment efforts.    


Jenifer S. Tucker (Associate)

Ms. Tucker obtained her law degree from the University of Arkansas School of Law in 1993 with honors and as Associate Editor of the Arkansas Law Review. When she was admitted to the Arkansas Bar in 1993 she held positions within municipal, juvenile and circuit courts. She was appointed Deputy counsel at the Arkansas Dept. of Human Services, where she acted as the director of an appeals and hearings unit that dealt with employee grievances and client administrative appeals on issues such as child abuse and Medicaid.

Ms. Tucker is an attorney/consultant with a practice concentration primarily in the areas of labor and employment and corporate law. Jenifer served as law clerk to the Honorable Joseph H. H. Kaplan, Chief and Administrative Judge for the Circuit Court for Baltimore City, and was admitted to the Maryland Bar in 1998. She then worked at the Centers for Medicare & Medicaid Services (“CMS”) first as a labor and employment attorney and then as special assistant to the Deputy Administrator and Chief Operating Officer of CMS. In her capacity as special assistant, she supported the Presidential appointee charged with running the day-to-day operations of the Federal Agency that oversees the Medicare program and housed approximately 4,500 employees. She also interacted frequently with members of the press and wrote and edited speeches and press releases. As an attorney for the Agency, she represented CMS in labor/management matters before the Federal Labor Relations Authority and Federal Service Impasses Panel and served as a member of the Agency’s negotiating team for the 2004 Master Labor Agreement with the American Federation of Government Employees, Local 1923. She also represented the Agency in all phases of labor and employee relations cases, including initial grievance processes to third-party practice. In addition to her representational responsibilities, she also drafted many policies and procedures and presented briefings on labor and employee relations issues. 

Ms. Tucker served as the Corporate Human Resources Director for the Leggett & Platt Aluminum Group, providing overall human resources guidance to and leadership for a manufacturing company with its corporate headquarters in Fayetteville. She provided day-to-day advice and counsel to human resources managers in plants across the United States and Mexico and conducted training for managers across the country on various labor and employment law issues. She also represented the company in matters before the EEOC, OSHA and the Office of Federal Contract Compliance Programs that monitors contractor compliance with certain non-discrimination and affirmative action provisions.
